Well, the story ends today. Since posting this, I have been in two phone-battles over this fine, to no avail!

Apparently, "someone" witnessed a cigarette end being thrown from the rear left passengers window of my car on the date specified. I tried to argue with the fiends on the phone that I dont smoke and so "IT COULDNT POSSIBLY HAVE BEEN MOI!"..but they werent having any of it.

"You are the registered owner of the car, so €125 please!" they said. Grrrrrr!!!! As it turns out, my brother thinks it may have been he who threw out the butt.

So, I've just filled out a postal order to the tune of €125 and am posting it to them this evening. I feel that this is a very hefty fine - I would understand if I had dumped a big plastic sack of rubbish from the car, but a cigarette butt is a bit of paper and would surely decompose quickly. Not that I'm condoning throwing them out either, I'm not - its just seems like a big fine.

What do you all think???? honestly?

To be honest, I don't think the fine is too high. You have to draw the line somewhere - littering is littering, it shouldn't matter how big the object(s) is/are you dispose of illegaly.
It's just unfortunate that it hit you, but think of all the eejits who go to McDonalds and then throw the whole stuff out of their car and other things. They need to be punished.
If I walk through Dublin it's disgusting what you see lying around. But then, are there really enough Wastebins around?

But don't get me wrong, you have my sympathy since you are clearly not guilty, but maybe it was your brother or somebody made a mistake. There is nothing you can do to change it... It's just bad luck.

So... some stranger reported that they purportedly saw you throw something out of your window? Unless they ran after the speeding butt after it supposedly left your car window, or they were driving RIGHT next to you (on a 3-lane highway, say) I can't see how anyone could know for sure what happened.

It sounds like you're being fined for a bunch of hearsay. Doesn't seem right or fair. Plus your brother should pay for at least part of the fine! Stupid brothers. ;)

Just saw Phil's response. I agree about the litterbugging - but I think you have to be caught as it happens. It makes it harder to stop litterbugs, but the law shouldn't leave room for maybes and I-think-I-saws.

Lol! Thats what I said Tway! They must have had super-vision goggles on or something to spot a cigarette being thrown from the car. Apparently, they dont have to provide any kind of proof for this which seems outrageous, but there's nothing I can do on this one.

Oh yeah! Better defend my little brother here - he's paying for the fine...I'm just doing it until he's back in gainful employment. (He's a poor student right now - we've all been there! )

Anyway, I'm going to be a litter-Nazi from now on! Anyone who sits into the Fiesta is going to be screamed at if they so much as roll down a window!!!

Yeah, I agree with you, tway. But that gives me an idea... Must get the licence plate of people who get on my nerves... Hehehe....

Or collect Licenceplate numbers of police cars...

Hee hee! Oh, the things one could do with such easy-to-come-by power.

I wish I could just write down the licence plate number of people that I see littering. I don't see it happen that much but when I do see someone throw something from their window it really bothers me (just think of the cumulative effect if everyone did it). But simply saying I saw this car throw something out the window would never stand up in a US court. You need to PROVE guilt. You need evidence (ie--the cigarette butt). You also have a right to question and confront your accuser, etc..

Anyway, bummer about the fine. Bet "little brother" is pretty depressed. I still find it amazing that they can actually collect a fine based on what someone told them.

Why don't you wait outside the station of the person you talked with, write down their licence number and say you saw them throw something out of their window. They'd get fined and realize how ridiculous it is to fine someone based on the hearsay of another person.

They gave me the guy's name - Joe Hayes - now, what good is that to me!! He could be anyone!
