My H1B on the passport has been expired but I have H1B extension approvel and new 1-94. On mt way to India, My home country for my H1B restamping i would intend to visit paris and switzerland. Can I get a schengen visa?

I wouldnt envisage it being a problem getting a schengen visa. To get one you must must apply to the embassy or consulate of that country responsible for the state where you live, in your case India.
If you intend to visit several Schengen countries, you must apply for a visa at the Embassy or Consulate of the country which is your main destination.

If you intend to visit several Schengen countries but do not have a main destination, you should apply for a visa at the Embassy or Consulate of the country which is your first point of entry.

here is where you can get information and an application form that you can hand into the French Embassy or Swiss embassy depending on which one is you main destination or which one you plan to enter first. Hope this helps:)

Thank you Lorcan,

Currently I am in united states, so I guess I should apply through french embassy in US. My concern is the expired H1B,eventhough Iam going to my home country. If the embassy is specific about the valid visa stapmed on the passport, then Idont think I will get visa.

However I will try my luck and add posting to help people with similar situation.

ranji,

it is very hard for a young single Indian male to get a Schengen visa. Make sure that the people at the French embassy know that you have a new I-94 and that you'll get a new H1B and that you'll go back to the states. Best submit copies of all the documents you got regarding your US visa with your Schengen visa application to the French embassy.

I got schengen visa today. In fact its not a problem as log as you have visa extension to stay in US.
