i got 28 days in jail for having a knife on me which was under the legale size (3 inches), but because it was a LOCK knife i was sent to jail...i done 2 weeks in jail and was let out.
Now im not a hardend criminal and the knife was part of a belt buckle that was but for me as a gift that had broke. i kept it in my pocket and wanted to get it fixed and forgot about it (thats how small the knife was).
1. Also i have been court subpoenad to go to America in two weeks as a character reference... "ironic"
2. I have made an appointment to go to the US embassy, but the interview is after the date that i need to actually be in America. can i still go to America without going to the US embassy to get the waiver/interview?

If I were you, I would contact the US Embassy and show them court subpoena. Under certain circumstances--which I believe this is one of them--they would expedite your application process.
Given your circumstances, and depending on your intentions, you cannot be summoned to appear in a US court outside of the jurisdiction (*but say certain Federal/family).
How were you served? Seems a bit strange. A judge certainly would not issue such outside of teh jurisdiction. If it was a friend...then the judge will be pissed if petty issue.
Call the embassy, tell them your situation, I'm sure you will get out of going....
UNLESS...that is the real point and you do want to go....embassy will deny you and have the summons to appear cancelled.
Definately call the embassy, as I have no idea of your circumstances and the court documents
