Iv been ask since Jan 12th 2009 with the new Visa Waivers can u travel to the USA with an conviction do they rely on people to tell the truth as they cannot screen every one who enters USA what do you think?
My mate went to Miami last year and did not declear he had an OLd conviction and would like to go to New York for new year and would like to know if the Visa Waivers changes things?
The clearest answer you will get has to be from the US Consulate. They will be slow and the result might need a second go at the question, but thats where you will get a full result.
A major rule with the visa waiver is that if you have a past criminal conviction then you "must" apply for a visa as you are not allowed a visa waiver. If you do not declare the conviction and do get caught then you (or your friend) will get denied entry and banned for a long time from re entering. If you declare the conviction you will probably also get denied a visa unless it was really a very long time ago and was something that was not drug or alcohol related.
