Hello there!

I have checked many, many websites and guides including governmental ones but... to no avail.

Anyhow, I'm currently an exchange student from Singapore, residing in Switzerland. I'm only here for one semester and entered in February 2010.

The University that I'm attending told me specifically (or told all the students) that we'll only require a Residence Permit which will be applied/issued only when we arrive in Switzerland.

So, I have done just that and my residence permit (Short term stay, Permit B) ends on the 30th of June 2010 (30/6/10).
Because I have consulted numerous, numerous people and EVERYONE has a different opinion, including the "professionals" at the immigration offices here, I would like to gather some(more) advice here.

The pressing issue is regarding my intended travel plan:

21/6/10: Leaving Switzerland permanently for London
22/6/10: Leaving London for Turkey
22/6/10-26/6/10: Turkey
26/6/10: Leaving Turkey for London
26/6/10-29/6/10: London
29/6/10: Leaving London for Vienna
2/7/10: Leaving Vienna for London
5/7/10: Leaving London for Paris
9/7/10: Leaving Paris for Florence
12/7/10: Flying to Singapore definitively

My question is, will I be allowed to be in Vienna once my permit of "sejour" or residence permit ends on the last day of June 2010? Or will I have problems when I try to enter London on the 2/7/10? Is my status after I "quit" Switzerland a tourist orr....?

Because the immigration office in Switzerland have informed me that once i enter the non-Schengen states(London and Turkey) I will have a renewal of status as a "tourist" and therefore, when I leave these states, I will be entitled another 90 days as a tourist, as a Singapore citizen, in the Schengen states. Is this true?

Or will I be in trouble and treated as an "illegal immigrant" if I stay in Vienna beyond the end of June 2010? That is, am i no longer allowed to re-enter the Schengen states after my permit for Geneva ends on the last day of June 2010? As another lady at the OCP informed me that after my permit ends and I leave the Schengen states, I will no longer be allowed to re-enter for another 180 days.

I have also gotten information that the Suisse residence permit is for the country that you're residing in for longer than 3 months i.e. Switzerland so when I leave the country definitively and travel within Europe, it's okay, as long as I don't return to Switzerland. BIG CONTRADICTION!

I am seriously dumbfounded by how I have two extremely different answers which may pose as problems at the immigrations at the various airports.

1) Singapore citizens have the 90 days of tourist status entitlement for all the countries that I've mentionned and we do not need visas for tourist entry purposes.
2) I have proof of documents for travel such as return E-ticket to Singapore, insurance, tickets for the trips etc etc; in case the immigration officers at the airports require them to ensure I'm not going to stay in the country/region forever...

FYI, situations like yours simply weren't considered when the Schengen Agreement was signed. It was difficult enough for the lawmakers to reach some sort of agreement, as a consequence the wording of the law is ambigious and complicated.

There are two opinions on the subject:

First and this is the majority opinion: In your situation you are not allowed to re-enter the Schengen area after June 30th. You will have to wait for 90 days until you are allowed back.

The second opinion is what the Swiss gave you:

If I was you I would play it safe and do the following:

1. Try to get an extension of the Swiss residency permit until July 12th. If this does not work do all your travel inside the Schengen area before June 30th.

2. It is a criminal act to enter Italy without a valid visa. This is a problem since you want to fly out of Italy on July 12th. Contact the Italian embassy and get it confirmed from them in writing that you can fly out of Italy even if your residency permit for Switzerland has expired.

3. Make plans to fly out of London and not Italy on July 12th.

The reason I give you this advice is because the majority of Schengen visa experts follow the first opinion. You could get into serious trouble if you followed the advise the Swiss authorities gave you.

Safe solution is that before expiry of resident permit, visit schegen countries and then visit other non schengen countries.

Try to ask for extension of your resident permit which might be difficult to get as it first depends on your university.

Though singapore citizens can stay 90days as a tourist, they MAY ask you to apply from your native country(singapore).
So best safe way is as above.
