Travel Forums Europe Schengen visa. 12 month working visa then tourist?

Hi everyone,

I have a tricky visa question. My girlfriend entered the Schengen area July 2012 via Switzerland to work for 12 months in The Netherlands. She already had the working visa upon arrival as the company employing her organised everything. So she traveled about 2 weeks then started work.

Her visa is up end of July 2013 and according to the Expat desk in Rotterdam she has another 28 days she can stay here in the Netherlands after the visa expires before she must leave to finalize bills / rental / etc.

Now upon her work visa running out, does she then automatically go onto a tourist visa? So she has another 3 months she can stay in the Schengen area after the day her work visa runs out? The expat desk said we should leave the Schengen area (to the UK) for a day min to reset her tourist visa. I am not sure how accurate they are so trying to get a second opinion.

It's confusing as I believe there's two possibilities. She was a tourist since August 2012, so she must leave the Schengen area and come back in 6 months after the date she entered (which means a year later is ok) or she has not used her tourist visa yet as she has had a working visa for 12 months thus still has 3 months she can use.

She is an Australian citizen.

Perhaps someone has an idea what we should / shouldn't do? I believe if we leave for the UK for a few days say the first week of August and then come back into the Netherlands, we should be ok to spend till mid September travelling about without risking an overstay.

Thanks any advise is welcomed.

Oliver.
