Hi there

My partner and I are currently in the exciting stages of planning a Europe trip for 2014. We are pretty sorted so far but are struggling with the issue of the Schengen visa so thought posting in a travel blog might help!

We are both from New Zealand and will be arriving in June 2014. We plan to travel for a total of 110 days and the countries we are seeing are as below:

1. France
2. Spain
3. Portugal
4. Croatia
5. Italy
6. Switzerland
7. Germany
8. Belgium
9. Netherlands
10. Poland
11. Czech Republic
12. Austria

I have an Irish passport so I believe I am exempt from the Schengen visa 'situation' however my partner is a NZ Citizen. The list above is the approximate order we will be travelling through the countries.

Our understanding is that once we reach Poland (on our 95th day in Europe!) he could be 'caught' as an over-stayer, as we would have already been in the area for more than 90 days and will have also left the initial 'bilateral visa waiver agreement' area to go into Croatia and back again.

As a side note, we will have a plane ticket booked out of Europe for a week later.

Does anyone have any ideas on how we can get around this? Does the return ticket home make any difference?

Any advice would be MUCH appreciated!!

Kiwis are in luck; New Zealand has agreements with many Schengen countries which supersede the Schengen rules, and allow staying in several Schengen countries for 90 days each, besides the 90 days in any 180 day window which applies in the rest of the Schengen area (not, not on top of; when there, your time in the other countries still counts). See the bottom of the Exemptions section in our Schengen Visa guide article for details, and links to official websites explaining the same.

Poland, Croatia and the Czech Republic are the only countries on your list for which New Zealand doesn't have that agreement, so I'd reorder your trip to make certain those are all visited within your first 90 days of arriving in the Schengen Zone, and then you'll be absolutely fine.

Thank you for the advice! We have re-ordered the trip - better that than huge fines!
