Hi there,

Can i apply for student visa to a different country while having a criminal record in USA as in a F1 Visa. Since the charges were misdemeanor and didn't show up in court due to family emergency!! just curious for the criminal background check. what would be the outcome i'm not a citizen nor a resident of United states and already left the states. I'm from india. I Would really appreciate the help:)

Is there a criminal warrant hanging over your head? Or did your no show end up as a plea of nolo contendere?

Maybe a check with your family lawyer would be best if you are still a minor.

"Student Visa??" Is this for a course of study or just a tourist visit?

Do you presently have a passport and source of financial support or looking for a grant?

Yes I was on a student visa and I'm no minor at all. I just didn't show up at the court, so they must have issued warrant on me.

Guess you just have to apply and wait and see.

Maybe look over the fine print to see if there is anything that applies to you.

If the position you are applying for requires a background investigation you will have to account for your time in the US.

What happens if i didn't admit? Since i'm not a citizen nor a resident will the immigration finds out? I was hoping for Australia but seems like they need my character and police report which i can get it from my home town with ease as i've never been convicted .

Your choice - but if you lie on an immigration form, obtain residency or citizenship and get in and then your dishonesty is unveiled, you'll be looking for another country to call home.

This has just come up in our newspaper regarding immigration. A bloke from elsewhere had settled in New Zealand, eventually obtained NZ citizenship but lied on the forms, saying he had no previous convictions. He's been stripped of his NZ citizenship.
