Yes simple assault isn’t a CIMT, because it doesn’t necessarily denote “intent” to cause harm, and no serious harm took place. Where as GBH and ABH do.

Hi I've had useful help off here in the past but now face a different situation I've previously been to the US twice on a ESTA despite having a criminal caution in the UK I'm now wanting to travel back to the USA for a couple of weeks but am currently on police bail under investigation I havn't been charged with any offence at this point.

If I attempt to travel will the US Passport Control know from my passport that I'm on bail and therefore deny entry or will it not show given I havn't been charged with any offence yet.

Thanks for any help given

Out on bail but not yet charged?!!! You've either got your terms wrong or you're trolling.

Trolling. Generally on bail you’re not allowed to travel and they tend to ask for your passport.

Not a helpful reply maybe understand UK law before commenting silly replies!

I was arrested and released on police bail whilst the alleged crime is investigated as of this point I'm still on police bail and have not been charged with any offence.

Trolling?? i can assure you if I was going to troll I wouldn't pick a thread on US immigration lets be serious!

In the uk when released on police bail you are given a set of conditions none of my conditions prevent travel abroad I've just been to turkey on holiday!

What I'm asking for help with is if I travel to the USA will my passport be flagged as been on police bail in the UK hence making the ESTA option not possible.

Any USEFUL HELP APPRECIATED

As far as I am aware the British authorities don't share any data on ordinary people with the US authorities.

I'm pretty sure any such data sharing would be at national level - Home Office or Interpol - for targets such as terrorists. Police bail is going to be local to your constabulary, I very much doubt there's data sharing.

No worries I'm on police bail for an alleged sexual offence but no charges have been issued in the UK when released on investigatory bail your given conditions if needed none of my conditions prevent travel outside of the UK and as explained I've recently been to Turkey on holiday with no issues but obviously the USA has stricter conditions so I'm not aware if being on police bill will flag up when going through border control which would obviously then make me unable to enter via the ESTA.

I think it was yourself who previously helped me with advice which helped me gain entry.

Firstly I currently have a USA ESTA around 5 months old is it worth reapplying for a new one to see if anything comes back different with my acceptance? or will this flag as strange applying twice within the two year period?

And the main question to your knowledge is my passport likely to be flagged on entry if I just travel without a new ESTA
